INFORMATION NOTICE ON THE PROCESSING OF PERSONAL DATA

 

Auditel S.r.l. hereby provides the information notice (the "Notice") regarding the processing of personal data of users (the "Users" or the "User") who use the Advertisers Portal (the "Advertisers Portal"), in their capacity as data subjects (the "Data Subjects").

 

Users acknowledge that their personal data will be processed in accordance with this Notice and in compliance with Regulation (EU) No. 679 of 27 April 2016, known as the General Data Protection Regulation ("Regulation" or "GDPR"), with other applicable provisions of European Union law, as well as with the applicable national data protection laws of individual Member States, as amended or replaced from time to time, such as Legislative Decree 196/2003 as amended ("Privacy Code" and, collectively, the "Applicable Privacy Law").

 

This Notice is provided exclusively for the Advertisers Portal and does not extend to any processing carried out by third parties which may be accessed by Users via links. With regard to such third-party processing, Auditel assumes no responsibility, and Users should refer to the individual privacy policies of those third-party websites.

 

1. Who is the Data Controller of your personal data?

The Data Controller of your personal data is Auditel S.r.l., with registered office at via Larga 11, 20122 Milan, Italy.

 

2. Who is the Data Protection Officer (DPO)?

The Data Protection Officer of Auditel, pursuant to Article 37 of the Regulation, can be contacted at the following addresses:

3. What are the purposes and legal bases of the processing?

Auditel, through the Advertisers Portal, may collect and process Users' personal data for the following purposes:

1. a) Activation and operational management of the services offered through the Advertisers Portal during the Beta Phase, including related activities such as maintenance, login system management, technical support, handling of reports, as well as administrative-accounting purposes and other activities connected to the relationship with the User. The legal basis for this processing is the performance of the service explicitly requested by the Users. Therefore, no express consent is required;
2. b) Pursuit of Auditel’s and/or third parties’ legitimate interests (e.g., right of defense in court, handling of complaints and disputes, prevention of fraud and/or unlawful activities), which, according to the Controller's assessment, do not override the fundamental rights and freedoms of the Users, and which constitute the legal basis for the processing;
3. c) Fulfillment of legal obligations, regulations, national and EU laws, and requirements issued by authorities empowered by law, which also represent a legal basis for the processing.

 

4. Methods of processing your personal data

Your personal data is processed using electronic and manual means, with logic strictly related to the above-mentioned purposes and in a way that ensures adequate security, in accordance with Article 5 of the Regulation.

 

5. Personal data processed, nature of the provision, and consequences of refusal

Auditel receives and collects, through the Advertisers Portal, information about Users who visit and/or use the services available on the Advertisers Portal. Specifically, Auditel collects and processes the following information.

• Data voluntarily provided by Users

 

Auditel limits the collection of information relating to Users strictly to the achievement of the purposes set out in paragraph 3 above and the services expressly requested. In particular, Auditel collects the following information:

• Company data of the entity requesting registration to the Advertisers Portal: type, business name, VAT number, registered office address;
• Contact person’s data: first name, last name, email address, phone number.

 

To register a company on the Advertisers Portal, the authorized contact person must submit a registration request by completing all required fields and correctly providing all the Advertiser’s details and the requested information, including the name, email address, and contact details of the company's representative.

 

During the registration process, mandatory fields are marked with an asterisk (*). Failure to provide the required data will prevent the successful completion of the registration process for the Advertisers Portal.

 

6. Will the data be disclosed to third parties?

Your personal data may be shared with the following categories of recipients:

• Auditel internal staff authorized to process the data (e.g., technical department, legal department), who access the data based on necessity;
• External entities, including public bodies, authorities, and institutions;
• Providers of technical and organizational services (e.g., IT systems management services).

An up-to-date list of recipients to whom Auditel discloses personal data may be requested by sending an email to: privacy@auditel.it.

Your personal data will not be disseminated, except as required by law.

 

7. Will the data be transferred abroad?

Personal data is stored on servers located in Italy, within the European Union. However, it is understood that the Controller may, if necessary, store data on servers outside the EU. In such case, the Controller ensures that the transfer of data outside the EU will be carried out in compliance with applicable legal provisions.

 

8. How long does Auditel retain the data it collects?

Data is processed for the time necessary to provide the service requested by the User and to perform the activities related and instrumental to it, as outlined in paragraph 3 above, and is deleted once the purposes for which it was collected and processed no longer exist. In particular, personal data will be retained for the entire duration of the service used by the User, and subsequently for the fulfillment of any obligations related to the termination of the service, including legal obligations and applicable statute of limitations.

 

9. What rights can the Data Subject exercise against Auditel?

Under the Regulation, you may, in the manner and within the limits provided by current legislation, exercise the following rights:

• Right of Access (Art. 15): You may ask for confirmation as to whether or not your data is being processed;
• Right to Rectification (Art. 16): You may request modifications, updates, or corrections to your data, especially if inaccurate;
• Right to Erasure (Art. 17): You may request deletion of all or most of your personal data, provided the processing is no longer necessary or if we are not legally permitted or required to continue processing;
• Right to Restrict Processing (Art. 18): You may ask us to limit the use of your data (e.g., if your data is inaccurate or if it is being held unlawfully);
• Right to Data Portability (Art. 20): You may request a copy of your personal data;
• Right to Object (Art. 21): You may ask us to stop using your personal data entirely (e.g., if we no longer have the legal right to use it);
• You also have the right to withdraw any consent previously given, with effect from the moment we are informed. The withdrawal does not affect the lawfulness of processing based on consent before its withdrawal;
• Finally, you have the right to lodge a complaint with the Data Protection Authority (garanteprivacy.it).

 

10. Changes to this Notice

Auditel reserves the right to make changes to this Notice at any time, giving notice to the User where necessary.
